ZAMBIA’S CYBER LAWS: SHIELDING DIGITAL LIVES

The recent enactment of Zambia’s Cyber Security and Cyber Crimes laws has sparked widespread misinformation, with opponents spreading half-truths and, in some cases, outright falsehoods. Regrettably, even the Law Association of Zambia (LAZ), of which I am a member, has not sufficiently clarified the complexities of these laws, leaving public understanding muddied.


As a former Board member and Legal Advisor for Bloggers of Zambia, a digital rights organization, I have spent years advocating for cyber safety and security. The debates surrounding these laws are often oversimplified, ignoring the nuanced balance between protecting digital spaces and preserving freedoms. As technology advances and more services move online, safeguarding our digital lives is as critical as protecting our physical well-being.

The scale of the cybercrime threat is staggering. In 2024, global cybercrime costs were estimated to be in the trillions of dollars, with the number only getting bigger, impacting individuals, businesses, and governments worldwide. Zambia is not immune—mobile money agents, banks, and ordinary citizens face relentless threats, from phishing scams to ransomware attacks.


Cybersecurity legislation is indispensable. These laws shield individuals, organizations, and governments from cybercrime, ensure data privacy and safety, and establish frameworks for order in the digital realm. They protect digital assets, deter cyberattacks, and provide legal recourse for victims.

Dismissing these laws as mere tools to suppress online freedoms is reductive and ignores their broader purpose. Zambia is not alone in this effort—per the United Nations Conference on Trade and Development (UNCTAD), 156 countries, or roughly 80% of nations globally, have implemented cybersecurity laws to address similar threats.


Over the coming days, I will share key provisions of the relevant legislation on this platform to foster informed dialogue and dispel myths. Cybersecurity is not about control; it’s about creating a safe digital environment for all.
