AFTER he pleaded guilty to defiling his own 13-year-old daughter, a 55-year-old man of Lusaka’s 10 Miles area has been found guilty of incest.
Lusaka magistrate Mutinta Mwenya yesterday convicted the man and committed him to the High Court for confirmation of the conviction at possible sentencing.
The offence of incest attracts a minimum 15 years jail term for anyone found guilty. 
“The matter is beyond my jurisdiction. You will mitigate at the High Court. I am now committing you to the High Court for mitigation and confirmation of my conviction and possible sentencing,” magistrate Mwenya said yesterday.
The man had earlier pleaded guilty and claimed he did not know what came over him, blaming the devil for the act.
Facts read by public prosecutor Joe Phiri is that on the material day, October 6, 2024, around 23:00hours, the accused’s biological daughter, pseudonym, Nono, was asleep at her neighbour’s home when her father called her.
The accused asked the child to go and sleep at their house and that he had bought the school books she wanted.
Mr Phiri said the accused told his daughter not be scared to sleep at the house.
“She went to sleep at her father’s house but before she could sleep, the accused got into the bedroom with a knife, and threatened her not to tell scream or tell anyone about what would happened and that if she screams, he would kill her”.
The accused locked the door, covered the girl with a blanket before he had carnal knowledge of her.
While this happened, the victim’s mother was in John Laing Township.
The following morning, the child alerted her neighbour about the sexual assault before the matter was later reported to the police.
A medical report showed that the minor suffered an 8 o’clock laceration on the bleeding private part.
Asked if the facts were correct, the accused said he neither threatened the daughter with a knife nor did he cover her with the blanket.
