Mwamba gets second bench warrant in 24 hours

LUSAKA Resident Magistrate, Trevor Kasanda has issued a second bench warrant against Patriotic Front faction member, Emmanuel Mwamba in a case where he is accused of strangling and squeezing the neck of a police officer who wanted to arrest him.

Mwamba is believed to have assaulted the officer in the due execution of his duty.

Magistrate Kasanda issued a first warrant on January 31, 2024 after Mwamba missed the court session twice without proper reasons.

The court gave him a benefit of doubt when he presented himself and apologized that he will never miss court again.

When the matter came up yesterday for continuation of defence, Mwamba was no where to be seen.

It was at this point when state Prosecutor, Robert Malama applied for a bench warrant.

Mwamba in this case pleaded not guilty to one count of Assault on a Police officer Contrary to Section 250(b) of the Penal Code Chapter 87 of the Laws of Zambia.

It is alleged that Mwamba on June 14, 2023 in Lusaka assaulted number 14598 Detective Inspector Steven Simwenda an officer of the Zambia Police Service, in the due execution of his duty.

It is also alleged that the incident happened in Woodlands area on Wednesday June 14, 2023 between 16:00 hours and 18:00 hours.

Meanwhile, the court also demanded that a surety explains why the accused person missed court.

And his surety, Mufulira member of parliament, Golden Mwila explained that Mwamba was unavailable because he dislocated his shoulder and was not able to travel from the United States of America where he is currently.

The court was not satisfied with the explanation as no medical report was presented before court as evidence.

The court said Mwamba’s warrant should be returnable on February 25, 2025.

In another case, On Wednesday February 5 this week, Lusaka Magistrate, Amy Masoja also issued a bench warrant against Mwamba for non-appearance in court.

In this case, Mwamba and 3 others are facing one count of disorderly conduct at the Police Station.

The court adjourned the matter to February 26, for return of bench warrant.
