HIGH COURT ORDERS RAPHAEL NAKACHINDA TO RETURN 26 MOTOR VEHICLES WHICH HE GAVE TO RB AS A ‘GIFT’.

High Court Judge, Pixie Yangailo has ordered Raphael Nakachinda to return motor vehicles to the Movement for Multiparty Democracy (MMD). In another landmark judgement delivered on 18, November 2024 involving the MMD, the judge ordered the beleaguered faction National Secretary of the Patriotic Front to immediately return all the 26 motor vehicles that he gifted to the late Former president Mr Rupiah Banda.

She further ordered that any vehicle that he will fail to deliver from that lot of 26 will be recovered from the estate of the late president.

The judgement further orders that the motor vehicles that were sold to unsuspecting buyers with any semblance of a contract will be honored by the party, while the monetary value will be recovered from Raphael Nakachinda and members of his Illegal committee.

Nakachinda has been ordered to personally account for a further 8 motor vehicles which he signed off in his ‘personal’ capacity. For the rest of the vehicles he has been ordered to to produce proof of authorisation from the illegals who would then pay the damages together as a team.

Failure to produce such authority will mean that, he would pay for the proceeds alone.

The judge has also ordered the treasurer of the illegals to render an account of all these financial transactions including the movement of monies in the 2 party accounts held at Zanaco Bank.

She has ordered a thorough audit of the accounts to reveal all the transactions that happened in those accounts during the time that Nakachinda held the National Secretary role illegally.

And she has ordered Zambia Police and RTSA to assist the party in the inspection of the register of Motor vehicles and in the recovery of all MMD vehicles across the country.

The National Secretary of the party, Hon Elizabeth Chitika who took out the action, as a counter claim against the membership suit of Nakachinda (which he later withdrew) has expressed great satisfaction with this outcome.

She has indicated that she will immediately get to work, to recover MMD property from wherever and whoever is holding on to it illegally.

She has asked all those who dealt with the illegal committee to access the motor vehicles of MMD to immediately contact her office in order to establish the status of the ownership.

If within 7 days from today the 25th of November, 2024 the holders do not comply, she will report all motor vehicles as stolen from the party.

Nakachinda has been ordered to pay costs for this action.
