The Football Association of Zambia (FAZ) Player Status and Transfer
Committee has adjudicated on multiple pending cases including Mutondo Stars’
Chisha Kampamba’s matter.
According to its latest rulings, the committee has thrown out the complaint by
former Kansanshi Dynamos coach Donwell Yobe who was seeking
compensation for unfair termination of contract.
In the case of Chisha, the committee heard that the player signed a contract with
Mutondo Stars Fc for a duration of Twenty Four (24) Months (1st November
2023 to 31st November 2025). The club reneged on its financial obligations to
the player for the months of March, April, May and June 2024. The player
formally sent reminders to the club on three occasions and all of them were
unheeded.
The player through his representative was seeking release and compensation
from Mutondo Stars but the club declined.
“The status of the player is that he is a free agent by termination of contract by
Just Cause and is free to move to a club of his choice and is free of any
obligation to the Defendant. The request by the complainant is granted. The
player must be allowed to move and play for any club of his choice,” reads the
verdict in part.
The committee directed Mutondo Stars to pay the player all outstanding dues.
In the case of Yobe the committee ruled that the coach had no case against
Kansanshi Dynamos as his case lacked merit as evidenced by the contract
signed by both parties.
“The complainant claims that Donwell Yobe, signed a contract with Kansanshi
Dynamos FC as a coach for a duration of Twenty Four (24) Months 25th March
2024 to 24th March 2026. That the defendant (Kansanshi Dynamos) on 8 June
2024, the defendant unilaterally terminated the employment contract,” reads the
verdict in part.
“That on the 7th August 2024 the Defendant responded to the default notice
stating that the complainant’s contract was terminated on the 8th June 2024
owing to unsuccessful probation as Head Coach due to poor performance.”
The committee noted that Yobe failed to meet key performance indicators to
sustain his contract beyond the probation period. Keeping the Solwezi based
side in the Super League during the 2023-24 season was among the three key
performance indicators assented to by both parties.
“That in accordance with the Separation Compensation section of the signed
contract, failure to attain Key Performance indicators was subject to termination
of which the Defendant is on terra ferma,” reads the verdict.
“That the demand for residue compensation by the complainant as relief is not
granted. That the demand for gratuity is not granted as the complainant was still
within the probationary period of 3 months at the time of contract termination.”
Kansanshi Dynamos was relegated after the end of the soccer season under
review.
On the Kampamba (Ronald) case, the committee ruled that the player’s claim
for unfair termination of contract lacked merit.
Kampamba had a contract with Kansanshi Dynamos Fc from 26 August 2022 to
31 July 2025 which was terminated on 17th November 2023 due to poor
performance and almost immediately entered into another contract with Nkana
FC.
Upon hearing both parties, the committee threw out Kampamba’s complaint for
lack of merit as a professional contract cannot have two contracts running
simultaneously and the complaint was submitted as an afterthought for claim for
loss of income.
“The committee makes no recommendations for any sanctions against any
party. That the complaint lacks merit and is denied,” ruled the committee
comprising Mwansa Kapyanga (chairperson), Patrick Ndhlovu (vice
chairperson) and Teddy Njovu.
